Terms & Conditions – Hill Country Estate Wines

General

Prices quoted on our website are inclusive of GST. You must pay us the full price quoted on the website at the time the order is submitted. Prices are given in New Zealand dollars.
We reserve the right to vary our prices without notice. No adjustments are made if the price of a product increases or decreases between the time the order is submitted and the time the product is delivered.
Prices and specials offered at our Cellar Door, in stores, and online may vary and may not necessarily be the same.

Transit Cost

Product prices quoted do not include transit costs. Any courier or handling charges in relation to your order will be notified to you at the time you place your order and will be added to the total price.
Online purchases will only be delivered within New Zealand and Australia.
We are not currently offering international delivery through our website. If you are an international customer and would like information on current shipping rates to your destination, please contact our team at [sales@hillcountryestate.co.nz].

Mistakes in Price Arising from Computer Error

In the event that computer error results in a material misstatement of the price of your order, we may, prior to your receipt of the order or at any time thereafter, require that you pay us the difference between the amount paid by you in respect of your order and the correct amount payable.

Product Availability

All products are sold subject to availability. Promotional items may be limited in quantity. We are not responsible for an inability to supply products where they are not available or where our stock of the relevant product(s) has been exhausted.

Title & Delivery

Title to products purchased online passes on delivery of the products.
We will use our best endeavours to dispatch orders within four business days after receipt of your order and confirmation via email. We are not responsible for any delay in delivery caused by any event beyond our reasonable control.
Delivery is complete when the products reach the address you have specified. If we have taken responsibility for delivery, we will replace at our cost any products damaged during delivery upon verification of the damaged goods.
Advice regarding shortages or damage must be given to our Customer Services team within three days of receipt.
Nothing in these terms entitles you to return products surplus to requirements or for any reason other than those outlined herein.

Payment Terms, Charges & Invoicing

You must pay us in full by credit card at the time you submit your order.
If you pay by credit card, you indemnify us against any default by your card provider.
We use secure payment providers to authorise transactions before charges are applied.

Warranties

We represent and warrant to you that products supplied are of merchantable quality and conform with New Zealand’s Consumer Guarantees Act 1993.

Cancellation, Return and Replacement

Cancellations, returns, and replacements are subject to clause 8 of this agreement and New Zealand consumer law.

Use of Your Information

Your use of our website will generate certain information, including IP address and usage data. We also record your contact details, payment information, and any related personal details supplied.
You acknowledge that Hill Country Estate Wines, our employees, carriers, contractors, and agents may use or disclose this information for purposes connected to the supply of products to you.
You may request access to, or correction of, personal information held by us at any time.

Consent to Receipt of Electronic Messages

By registering on our website you consent to being included in our marketing database and agree to receive regular promotional communications. You may request removal from these communications at any time.

Intellectual Property Rights

All rights, title and interest in all intellectual property in the Hill Country Estate Wines online store and its contents remain the exclusive property of Hill Country Estate Wines and are protected under New Zealand law. No licence is granted to you under these terms.

General Terms

• No Waiver – Delay or neglect in enforcement of these terms does not constitute waiver of rights.

• Severability – If any part of these terms is found to be invalid or unenforceable, the remaining terms remain in effect.

• Privity – Third parties may benefit from rights expressed for their benefit under the Contracts (Privity) Act 1982.

Jurisdiction

This website is intended for New Zealand residents. If you access it from outside New Zealand, you are responsible for complying with local laws.
This contract is governed by New Zealand law, and any legal action must be taken in a New Zealand Court.

Assignment

You may not assign any rights under this agreement without our prior written consent.
We may assign our rights under this agreement without seeking your consent.

Notices

All invoices and notices will be sent to the address you nominate as your preferred method of contact. You are responsible for keeping this information up to date. A notice is deemed received if sent to the last address provided.

Amendments

We may amend these terms by notice via your nominated contact method. Amended terms take effect from the date stated in the notice, but no later than 30 days after the notice is sent.
